Terms of service

Thank you for choosing RADAR as your on-demand project tracking and reporting software. The following Terms of Service (“Terms”) govern your use and access to the RADAR system hosted at https://projects-radar.net/ and the RADAR website operated at https://projects-radar.com/ (collectively, the “Services”). Please read these Terms carefully before using or accessing our Services to know upfront your responsibilities and what you can expect from our Services.

 

Agreement to the Terms of Service

By using and/or accessing the Services, you agree to the terms and conditions set out in these Terms of Service. Together with the Privacy Policy, this document constitutes a binding legal agreement between you (the “Client”) and GET Information Technology GmbH (“we,” “us,” and “our”), the owner and provider of the Services.

If you are entering into this agreement on behalf of a business, company or other legal entity, you represent that you have the authority to bind such entity to these Terms. In that case, “you,” “your” and “Client” shall refer to that company or other legal entity.

If you do not agree with these Terms, do not access or use our Services. Violation of any of the terms will result in suspension or immediate termination of your account.

Changes to the Terms of Service

We may revise and update these Terms from time to time in our sole discretion to better reflect any new laws and regulations or our latest changes to the Services. All modifications are effective immediately after we post them. If an upcoming update to the Terms is material and affects your use of the Services or your legal rights as a user of the Services, we will notify you of this in a duly manner prior to the update’s effective date. You may always access the most current version of the Terms at https://projects-radar.com/terms-of-service.

If you do not agree with all or any part of the changes, you must cancel your account before the update becomes effective. By continuing to use and/or access our Services after the revised Terms are posted, you accept and agree to be bound by the new terms of conditions.

 

Use of the Services

You are responsible for your conduct while using the Services and any activity on your account, whether you authorized that activity or not. By using the Services, you agree that you will comply with all laws and regulations applicable to your use of the Services, including but not limited to copyright and privacy laws, and to the following Terms:

  • You may not purchase, use, or access the Services for the purpose of building a competitive product or service or for any other competitive purposes.
  • You may not register for the Services using automated methods or attempt to access the Services in any way other than through the interfaces and instructions that we provide.
  • You must not modify, adapt or hack the Services or modify another website or software product so as to falsely represent their affiliation with the Services.
  • You may not sell, rent, lease or loan your access to the Services, without express written authorization from GET Information Technology GmbH.
  • You may not misuse the Service, engage in abusive or excessive usage, interfere with the normal operation of the Services, or deny other access to the Services.
  • You may not probe, scan, or test the vulnerability of the Services, unless specifically authorized by GET Information Technology GmbH in writing.
  • You are responsible for keeping your login credentials secure and confidential to prevent unauthorized access to your account. You must notify us immediately if you detect a breach of security. GET Information Technology GmbH will not be liable for any damages incurred as a result of your failure to do so.
  • You may not use the Services to engage in any illegal activity or to transmit any viruses, malware, or other types of malicious software, or links to such software.
  • You may not use the Services to upload and disseminate unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, otherwise objectionable, or copyrighted material. We may, but have no obligation to, remove any content we deem at our sole discretion to be unacceptable or in violation of these Terms.

If we detect signs of suspicious activity or identify violations of our Service policies and terms, we may temporarily suspend or terminate your access to the Services, or any part thereof, at any time without prior notice.

 

Intellectual property and copyright

We respect the copyright law and expect the same from our Clients. The Services are protected by copyright. You may not reproduce, duplicate, copy, reverse engineer, decompile or otherwise attempt to extract the source code of the Services or any part thereof. Your use of the Services does not grant you any rights, implied or otherwise, to the other’s content or intellectual property, including intellectual property rights over any portion of the Services.

We claim no intellectual property rights over the information you enter, upload, or otherwise provide to the Services. You are the sole owner of any such content, as long as it does not infringe the intellectual property rights of others. We strive to respond to notices of alleged copyright violations submitted to support@projects-radar.com in appropriate manner and reserve the right to remove any content we deem unlawful as well as to terminate your account in case of repeat infringement.

 

Fees and payments

Subscriptions

Apart from the trial period, which is offered without charge, the Services are provided for a fee on a subscription basis (“Subscription”). A Subscription can be purchased through the RADAR system (“Online Subscription”) or using an ordering document (“Order Form Subscription”).

The cost of the Subscription is calculated based on the number of active projects and a selected billing cycle, as per the most current pricing information publicly listed on the Services. If you choose to upgrade to any of the paid plans, you shall pay fees to GET Information Technology GmbH, in accordance with the pricing and payment terms applicable to the Services at the time of purchase.

 

Free trial

The free trial period begins immediately after account registration is completed and lasts for 14 days. No payment information is required for signing up. Unlike paid subscription plans, the free trial has no limits neither on the number of projects nor the number of users.

At the end of the trial period, the account is deactivated and is preserved in read-only mode for 30 days. The account may be reactivated at any time during this period by adding a valid payment method and upgrading to any suitable paid plan. Unless a Subscription is purchased before the end of the 30-day period, all data entered into the system along with any configurations and customizations made by or for you will be permanently deleted.

 

Billing and payment methods

The Services are billed in advance on a recurring and periodic basis, following either a monthly or annual billing cycle. The Subscription renews automatically on the same day of the month as the purchase date, unless a request to cancel the Subscription is received. For details on how to cancel the Subscription, please see the Cancellation section.

In the case when a Subscription is purchased on a day not contained in the following or any other month, the Subscription renewal date is moved to the last day of that given month. In other words, if the Subscription begins on March 31, the next payment will be scheduled for April 30, and the provided payment method will be charged the applicable fee on that date.

Depending on the type of Subscription you purchase, various payment methods may be used. A valid debit or credit card is necessary to pay for the Online Subscription. All major card providers are accepted. In addition, fees for Order Form Subscription can be paid by bank transfer.

For Online Subscriptions, access to the Services is provided immediately after the preferred payment method is added and the applicable fee is successfully charged. You are responsible for keeping your payment and billing information accurate, complete and current to avoid losing access to the Services. You may update your payment details at any time and without charge, provided this does not interfere with processing of recurring payments.

The fee on Order Form Subscription shall be paid in accordance with individually agreed payment terms but no later than 14 days after the agreed start of your Subscription. If no payment is received by the end of this period, the account is deactivated and retained in read-only mode for 30 days.

 

Taxes and other charges

All prices listed are exclusive of Value Added Tax (VAT). Unless you provide a valid VAT ID number issued by a taxing authority in the European Union to confirm that you are purchasing a Subscription for business purposes, VAT at the German rate of 19% will be added to the total charge.

Additionally, you are responsible for any extra expenses related to your payment, such as credit card processing fees or bank transfer charges.

 

Price changes

Because we constantly work on improving our Services, we may also from time to time revise Subscription fees and the scope of Services offered at the listed price. We will communicate any such price and plan changes to you in advance.

The new fees will take effect at the start of the next billing cycle of your Subscription following the announced date of the price change. By continuing to use the Services after the price change goes into effect, you accept to be billed the new applicable fee. If you do not agree with a price change, you may cancel your Subscription prior to the effective date of a price change. For more information on how to do this, please see the Cancellation section.

 

Refunds

Any paid fees are non-refundable, regardless of whether you use the Services. Except as specified in the Upgrading and downgrading section of these Terms, no refunds or credits will be issued for any unused trial days, partially used months, or partial annual use of the Services on any of the paid plans.

Upgrading and downgrading

You are free to change your plan level at any time. For any upgrade or downgrade in plan level within Online Subscription, the requested change will occur immediately.

Plan change in the middle of the billing cycle is subject to proration, i.e. a charge adjustment that accounts for the unused portion of the month and the new price applicable to it. In the case of an upgrade, this partial month charge results in an additional expense included in the total amount due on the next Subscription renewal date. For downgrades, the unused portion of the old, more expensive plan is converted into an account balance, which is then used to cover a part of the payment charged on the next Subscription renewal date.

Change in plan level for Order Form Subscriptions may be subject to a supplemental agreement.

Downgrading from one paid plan to another is only possible if the number of active projects added to the system does not exceed the limits of a selected paid plan. The same requirements apply to upgrading from the trial plan to any of the paid plans.

 

Cancellation

You are free to stop using the Services at any time.

You may choose to end your trial prior to the expiration of the 14-day period by deactivating the system. In this case, all remaining free trial days will be cancelled immediately, and your account will enter a read-only mode for 30 days.

To cancel Online Subscription, follow instructions on the Billing & payments page, or by contacting our customer support team at support@projects-radar.com. Despite the pronounced cancellation, you will continue to retain full access to your account until the end of the then-current billing cycle. Following this, your account will be deactivated and made available in read-only mode for a period of 30 days to give you the opportunity to export the stored content or to resume your use of the Services.

Order Form Subscription is cancelled following a written cancellation request sent to our customer support team by email at support@projects-radar.com. The request must be submitted at least 14 days before the end of the then-current billing cycle. Failure to do so will result in automatic Subscription renewal, and the Client will be billed for the next billing cycle.

 

Account suspension and termination

We may suspend or terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. Where possible, we will endeavor to give you reasonable advance notice before this happens to let you know of the steps you can take to remedy the activity that prompted us to contact you. If the activity proceeds beyond the terms specified in the notice, we will terminate your access to the Services.

We reserve the right to suspend your account in case of late payment. In the case where we are unable to charge you for Subscription on the scheduled Subscription renewal date, we will first let you know of this by email to give you the opportunity to correct or update your payment and billing details. Following this, we will make several additional attempts to charge your payment method. Should all of them fail, and your payment becomes overdue by more than 14 days, your account will be deactivated due to non-payment. You may continue to access your account in read-only mode for 30 days, but your data will be made available to you again only after receipt of the outstanding payment. Unless the due amount is received in full by the end of the 30-day term, your account will be permanently terminated, and any stored content will be deleted from our system.

 

Changes to the Services

We constantly improve and enhance the Services. We may add, alter, and remove minor features at any time without prior notice. In case of any significant modifications to the core functionality that may affect your use of the Services, we will provide you with reasonable advance notice to give you the chance to adapt your use of the Services or to export a copy of the contents of your account, should you choose to stop using the Services.

 

Privacy

We collect and process certain information about the users of our Services to the extent necessary for the provision of agreed Services. For more details on our privacy practices, please refer to our Privacy Policy.

Disclaimer of warranties

Your use of the Service is at your sole risk. To the extent permitted by law, the Services are provided on an “as is” basis without warranty of any kind, whether expressed or implied. We do not guarantee that the offered Services will meet your requirements, be error-free, or that they will be available at any time, from any location and without interruption.

In no event shall GET Information Technology GmbH be liable for any direct, indirect, consequential or incidental damages arising out of the use of or permanent or temporary inability to use the Services.

We take appropriate measures to safeguard your personal data and the contents of your account and offer full daily data backups as part of the Services. Despite this, we do not provide a general data protection guarantee for the information that you enter or upload into the system and thus cannot be held responsible for the loss of any such information. We urge you to back up your data regularly to prevent any damages resulting from accidental loss, corruption, or partial removal of the stored content or data.

 

Governing law and jurisdiction

All matters relating to these Terms of Service or the Services, including any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the internal laws of the Federal Republic of Germany.
